Steady
Terms of use
In an emergency, call 911. Steady doesn't call emergency services or anyone else on its own, and it may not work when you need it. Don't wait on the app to get help.
In short: Steady is free. It isn't a medical device and doesn't replace your doctor or emergency services. The timer, reminders and texts aren't guaranteed to work, so don't rely on Steady alone. We provide Steady as it is, and our liability is limited as far as the law allows. The full terms below are what count.
Agreeing to these terms
These terms are an agreement between you and Byte Logic Company (“we”, “us”), which makes Steady. By downloading or using Steady, you agree to them and to our privacy policy. If you don't agree, don't use Steady.
You must be at least 18, or the age of majority where you live, to accept these terms. A younger person may use Steady only with a parent or guardian who accepts these terms for them. If you set Steady up for someone you look after, you accept these terms for your own use of it and for theirs.
Not a medical device
Steady is a tool for organizing and reading back information you enter. It isn't a medical device. It doesn't detect, predict, monitor, diagnose, treat or prevent seizures or any other condition, and nothing in Steady is medical advice.
- The care plan, rescue medication, doses and timings in Steady come from you and your care team. Steady shows what you enter; we don't check it, and we aren't responsible for whether it's right for you.
- Always follow the instructions of your doctor or care team. Talk to them before you start, stop or change any medication or treatment.
- Reports, charts and counts in Steady are only as complete as what was logged. Don't use them as the only basis for a medical decision.
- Using Steady doesn't create a doctor–patient or any other professional relationship with us.
In an emergency
Call 911, or your local emergency number if you're outside the US. Steady doesn't contact emergency services, your contacts or anyone else on its own. The call button only opens your phone's dialer, and Text my contacts only opens your messaging app; nothing happens until you place the call or tap Send. Never delay calling for help because of anything Steady shows, or doesn't show.
No guarantee that Steady works
We work hard to make Steady dependable, but we don't promise that any part of it will work every time, on time or without errors. That includes the seizure timer and its prompts, medication reminders and other notifications, texts and map links, the call button, widgets, Siri and the Action button, speaking instead of typing, photo scanning, reports, and backup and restore.
These features depend on things we don't control, such as your phone and its settings, the operating system, notification permissions, Focus or Do Not Disturb, battery saving, signal, your carrier, and services from Apple and Google. For example:
- A reminder or timer alert can arrive late, or not at all.
- A text may not be sent or delivered, and Steady can't confirm that it was.
- A location in a map link can be wrong or missing.
- An update to your phone or to Steady can change how a feature behaves.
Don't rely on Steady as your only timer, reminder or way to reach help. Keep a written copy of your seizure action plan, and make sure the people around you know what to do without the app.
Your information and your part
Everything you enter stays on your phone, as the privacy policy explains. Because we never receive it, you're responsible for:
- what you enter, and keeping it accurate and up to date;
- asking people before you add them as emergency contacts;
- keeping your phone secure, and saving backups if you want them. We can't recover anything that's lost or erased;
- any phone, data or messaging charges from your carrier.
Your license to use Steady
We give you a personal, non-exclusive, non-transferable license to use Steady on phones you own or control, for your own non-commercial use, under these terms and the rules of the store you got it from. We, and our licensors, keep all rights in Steady, including its design, text, code and name.
You agree not to copy, modify, sell or redistribute Steady; not to reverse engineer it, except where the law allows; and not to use it unlawfully or to harass anyone, including through messages to contacts. When you use Steady, you also agree to follow the terms of the other services it relies on, such as your carrier's.
Price and changes to Steady
Steady is free. We may change, suspend or stop offering Steady or any feature at any time, without notice. If we add paid features in the future, you'll see the price and any extra terms before you pay.
No warranties
To the fullest extent the law allows, Steady is provided “as is” and “as available”, with all faults and without warranties of any kind, whether express, implied or statutory. We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and that Steady will be uninterrupted, timely, secure or free of errors.
Limitation of liability
To the fullest extent the law allows, Byte Logic Company and its owners, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any personal injury, illness, death, or loss of data, arising out of or related to Steady or these terms. This includes harm from a timer, prompt, reminder, text or other feature that fails, is late or is wrong, and from relying on anything shown in Steady. This applies whatever the legal theory, including contract, tort (including negligence), product liability or otherwise, and even if we were told such harm was possible.
Our total liability for all claims about Steady or these terms is limited to the greater of the amount you paid for Steady in the 12 months before the claim, or US$50.
Some states and countries don't allow some of these exclusions or limits, so some of them may not apply to you. Where that's the case, our liability is limited to the smallest amount the law allows. Nothing in these terms limits any liability that can't be limited by law.
Indemnity
To the extent the law allows, you agree to defend and compensate Byte Logic Company against claims, losses and costs, including reasonable legal fees, that come from your misuse of Steady or your breach of these terms.
App Store and Google Play
If you got Steady from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies, together with these terms. You and we agree that:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for Steady and its content;
- Apple has no obligation to provide maintenance or support for Steady;
- if Steady fails to meet a warranty that applies by law, you may notify Apple, and Apple will refund the price you paid for Steady (if any). Apple has no other warranty obligation for Steady;
- Apple isn't responsible for any claims about Steady, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone else's intellectual property. We are, to the extent these terms say;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you got Steady from Google Play, Google Play's terms apply to the download, and these terms apply to your use of Steady. Google isn't responsible for Steady.
Wherever you got Steady, you confirm that you aren't in a country under a US government embargo or designated by the US government as “terrorist supporting”, and that you aren't on any US government list of prohibited or restricted parties.
Ending these terms
You can stop using Steady at any time by deleting it. We may end your license if you break these terms. The sections on not being a medical device, warranties, liability, indemnity and governing law keep applying after these terms end.
Governing law and disputes
These terms are governed by the laws of the State of Illinois and the federal laws of the United States, without regard to conflict-of-law rules. If you have a problem with Steady, please email us first, and give us 30 days to try to put it right. Any claim that we can't resolve that way must be brought in the state or federal courts located in Dupage County, Illinois, and you and we agree to those courts' jurisdiction. This doesn't take away any right your local consumer law gives you to bring a claim where you live.
Changes to these terms
We may update these terms, for example when Steady gains a new feature. The date at the top shows when they last changed. If a change is significant, we'll say so in the app or on this page before it takes effect. Using Steady after a change means you accept the updated terms.
General
These terms, the privacy policy and the terms of the store you got Steady from are the whole agreement between you and us about Steady. If a court finds part of these terms unenforceable, that part is limited as little as possible and the rest stays in effect. If we don't enforce a term straight away, we haven't given up the right to. You can't transfer these terms to anyone else; we may transfer them if Steady changes hands.
